The clauses stated below apply as law to both parties and the customer acknowledges having taken note of them when placing an order.The general terms and conditions can be consulted on the website at all times and can be sent to the customer free of charge upon first request.

  1. Priority

Our general terms and conditions take precedence over those of the customer and, unless otherwise specified, the customer waives his own general terms and conditions. If, in addition to our general terms and conditions, other special terms and conditions apply, the above shall also apply to those special terms and conditions. If our general terms and conditions should be in conflict with these special terms and conditions, the customer can always rely on the clause which is the most advantageous to him.

  1. Offer

The offer is without obligation. HOUSE OF NANZ is entitled to change and adapt the offer. The offered goods will be described as completely and accurately as possible. The description is in any case sufficiently detailed for the customer to make a proper assessment of the product. If images are used, they are a true representation of the offered goods. If an offer has a limited validity or is subject to certain conditions, this will be explicitly mentioned in the offer. HOUSE OF NANZ is not bound by obvious errors or mistakes in the offer.

  1. The price

During the period of validity mentioned in the offer, the prices of the offered goods and/or services shall not be changed, except for changes in VAT rates. Our prices include VAT, taxes, duties and services. Shipping costs may be added to the purchase price. The customer will be informed of this before the purchase is finalised.

  1. Payment

Payment can be made by one of the methods indicated on the website. After payment, you will receive an e-mail confirming the order placed by you. HOUSE OF NANZ remains the owner of the goods until full payment has been made by the customer.

 

  1. Delivery and execution

The delivery of the ordered product shall be made to the address indicated by the customer. HOUSE OF NANZ shall not be held liable in any way for errors made by the customer regarding the delivery or billing address or for any subsequent delivery or the impossibility of delivering the ordered products due to such error made by the customer. HOUSE OF NANZ endeavours to deliver within a period of 5 working days after receipt of the payment. The delivery period is provided for information purposes only and is not binding on HOUSE OF NANZ. A delay in execution does not entitle HOUSE OF NANZ to compensation or to dissolve the contract. If the delivery of an ordered product turns out to be impossible, HOUSE OF NANZ undertakes to notify the customer thereof within a period of 15 days, whereupon the order shall be cancelled and the amount refunded to the customer's account. The risk of damage and/or loss of goods shall remain with HOUSE OF NANZ until the time of delivery to the customer, unless expressly agreed otherwise. HOUSE OF NANZ shall not be held liable for consequential damage resulting from late delivery or non-delivery by the courier service that was ordered.

  1. Right of withdrawal

The customer has a period of 14 days to withdraw from the contract without giving any reasons. The cooling-off period commences on the day following receipt of the product by the customer. During the cooling-off period, the customer must handle the product and its packaging with care. The customer shall only unpack or use the product to the extent necessary to judge whether he wishes to keep the product. Returned goods must not have been used. If the customer wishes to exercise his or her right of withdrawal, he or she shall be obliged to inform HOUSE OF NANZ thereof within a period of 14 days after receipt of the product by sending an e-mail or a postal form attached to the product. After the customer has notified HOUSE OF NANZ that he or she wishes to exercise his or her right of withdrawal, the customer shall also return the product within the same period of 14 days after receipt. If the customer exercises his/her right of withdrawal, the product shall be returned to HOUSE OF NANZ with all delivered accessories, if possible, in its original condition and packaging. If the customer makes use of the right of withdrawal, the costs of return shipment shall be borne by the customer. HOUSE OF NANZ undertakes to reimburse the amount paid by the customer within a period of 14 days after the exercise of the withdrawal right, on the understanding that, at that time, HOUSE OF NANZ must already be in possession of the returned product or a conclusive proof of the return may be submitted to HOUSE OF NANZ.

  1. Conformity and guarantee

HOUSE OF NANZ guarantees that all goods shall conform to the order and meet the normal expectations that the customer may have, taking into account the specifications of the good. HOUSE OF NANZ also guarantees that all goods comply with the statutory provisions applicable at the time of the formation of the contract. HOUSE OF NANZ uses the statutory minimum guarantee period of two years, which concretely means that, in the event of defects or flaws to the good up to two years after the delivery, the good will be repaired free of charge or replaced, on the understanding that each defect or flaw must be reported to HOUSE OF NANZ by the customer within a period of not more than two months after its observation. If the defect or fault manifests itself within a period of six months after delivery, the defect or fault is deemed to have existed prior to delivery, unless HOUSE OF NANZ can prove the contrary. If the defect or flaw manifests itself after six months after delivery, the customer must prove that the defect or flaw was already present at the time of delivery.

  1. Force majeure

In the event of "force majeure", HOUSE OF NANZ is not bound to perform its obligations. HOUSE OF NANZ may then either suspend its obligations for the duration of the force majeure or definitively dissolve the agreement. Force majeure is any circumstance beyond our control which fully or partially prevents the fulfilment of our obligations. Force majeure includes: strikes, fires, business interruptions, energy interruptions, interruptions in (telecommunications) networks or connections or communication systems used and / or the malfunctioning of our website, late or non-delivery by the suppliers or other third parties used.

  1. Intellectual property

The website and all drawings, photos, logos, ... placed on it are the exclusive property of HOUSE OF NANZ. It is prohibited to copy or reproduce them without the prior and express written consent of HOUSE OF NANZ.

  1. Applicable law and competent court

This contract is governed by Belgian law. Any dispute regarding the conclusion, validity, interpretation or performance of these terms and conditions, as well as any other dispute concerning or relating to this agreement, shall fall within the exclusive jurisdiction of the courts of the district of West Flanders, BRUGGE Division.
